Placing an Order:

Please ensure that you have read our terms and conditions. By placing an order with us, you are deemed to have read, understood, and agreed to these terms and conditions. If you are unhappy with or do not understand any aspect of our terms and conditions, please contact The Safari Store before placing an order on this website.

A contract between the customer and The Safari Store Ltd for the sale of our products will only exist once an order has been accepted, paid for in full, processed, and despatched. Prices and availability of goods are subject to change without notice.

Your Right To Cancel:

You may cancel your order (once accepted by The Safari Store) for any reason within one hour of placing your order. If you do cancel the contract within this time, any payments made by you will be refunded within 30 days, but please note that we do charge a 3.5 percent cancellation fee to cover the card fees we will have had to pay.

Once an order has been despatched, we are not able to to recall it and will be unable to cancel your order. You are the owner of the goods the moment your parcel leaves our warehouse.

Secure Payment and Taxes:

We accept payment in two ways:

1. By credit or debit card

2. By bank transfer

Our online payment gateway - managed by Sagepay, with Paypal as a back-up option too - is completely safe and secure to use. We also hold the Certificate of PCI DSS Merchant Compliance. This means that we maintain rigorous data security standards to ensure that our customers credit card information remains safe. This is obtained after our security and payment system have been independently audited by SecurtyMetrics on behalf of HSBC. Should you wish to view our certificate, please e-mail us and we will send the link to you.

All transactions are shown in Pound sterling, US dollars, or in Euros, depending on your location. All prices quoted on this website are accurate at the time of publication and, where appropriate, are inclusive of UK sales tax (VAT) at the current rate. The current rate of VAT is 20 percent. Any customs or import duties levied once the package reaches your designated delivery destination country will be your responsibility to settle with the customs office in that country. We have no control over these charges and cannot predict them nor pay them on your behalf and they are for your account.

Missing items from an order:

We scan all items twice when we fulfil your order. First when we pick the items you have ordered from our shelves; and a second time as we pack them into your parcel. It is therefore almost impossible that we ship an order without all the items you have ordered. When you receive your order please check that you have received all items straight away. We allow 5 business days from the date when your order was delivered to you for you to report any items missing. Please reply to one of the order emails we have sent to you, or email service@thesafaristore.com to let us know. We will then investigate this through our system and team to work out if this is possible and get back to you with a response. On the rare occasions where shortages have been reported, it has turned out that someone in the clients household had removed the missing item or items.


Delivery:

All timings for delivery are based on information from couriers and postal services and should be deemed to be approximates.

Ownership in the goods transfers to you on receipt of payment. On despatch, you become the importer of the goods and are responsible for the shipment of goods into your country.

Please always select the delivery method which allows for a reasonable amount of time for your parcel to arrive. If you are leaving soon, then opt for the fastest courier option. Should you be concerned about a parcel going astray, please opt for a tracked service - and please monitor the tracking information once a day to see if the goods have been delayed for any reason by the customs department or the courier. The tracking page will have links to the contact information for the courier in your country and they will be able to assist you in clearing goods into your country. We are not able to assist you in finding a parcel should you have opted for an untracked service.

International shipments (sent to addresses outside of the UK) may take longer and are subject to the shipping method being used and factors including but not limited to: the time it takes to clear customs, the time it takes for you to settle your account with customs, local weather, and local delivery to you.

Clearing goods through customs is out of our hands. We provide all the correct paperwork with each shipment, but the relationship is between you, the courier, and the customs department in your country as you are the owner and importer of the goods. We have no control over this process. All customs and courier charges related to the clearing of goods into your country are for your account and are not covered by The Safari Store. Should you opt not to pay to have the goods cleared, then we will not automatically arrange for the goods to be returned to us without clear instruction from you, the client, in writing to give us permission to do so - and permission to charge you for any related costs we may incur before refunding you for your returned order. Please note again that we are not able to do this without written permissions from you, the client. If this is not received in good time, then the courier will usually abandon your parcel to the relevant customs department in your country and no refund will be issued by The Safari Store for the goods. Refunds are only ever made where goods are received back by The Safari Store in saleable condition - as per our returns terms and conditions

Please ensure that all goods which you order from The Safari Store to import into your country fall within the regulatory laws of your country. As the receiver of the goods, it is your duty to do so. Failure to do so could mean that your shipment is not allowed through customs in your country, resulting in delays and costs which would be for your account.

We now offer DHL+DUTIES PAID as a shipping option for certain countries - DHL+DUTIES PAID will be shown as a shipping option if available for your country. When selected for your order 'DHL+DUTIES PAID' allows you to save when you pre-pay your duties through The Safari Store. Duties paid are shown in your order summary just above the 'Total' amount.
With this service 'duties' includes duties, taxes, and clearance fees - which we pay on your behalf. You are still the legal importer of record for your country. We are not able to reclaim duties, taxes, and clearance fees, and so 'duties' pre-paid are not refundable, even where items are returned to us. By proceeding with DHL+DUTIES PAID option you agree to these terms.
If you have selected DHL+DUTIES PAID as a shipping option and DHL is still trying to charge you for your import, please contact us straight away to let us know and we will chat to DHL for you.
Note that DHL+DUTIES PAID will not apply to split orders for liquids and you will still need to pay duties for those items shipped separately. Duties paid will only apply to the order number where DHL+DUTIES PAID is showing as your shipping option. The split is shown in the basket before you order.

The choice of which delivery service to use is up to you as our client to decide at checkout. Please use your discretion as we will send your order using the service which you select. Should we find a more cost effective delivery method for your parcel, then we will contact you to give you the option to use this method.

Where you have opted to cancel items off your order, we will still automatically use the delivery method which you selected at checkout unless you advise us otherwise before your order has been despatched.

Once an order has been despatched, we are not able to to recall it.

Balance Paid on Return - BPR - shipping offers: BPR stands for Balance Paid on Returns. As the name suggests you only pay the balance amount due for delivery if you return items to us. Return no items - or just a few - and you will enjoy the savings made on shipping your order to you.For returns made we only charge $5.00 per return item capped at the balance owed to The Safari Store for delivery. This cap is calculated as the difference between the DHL Express normal price and the amount you paid for the DHL Express BPR offer. It is a no-brainer really to use this offer as you never pay more than the DHL Express amount shown alongside the DHL BPR offer in the basket and you save if you return a few or no items. For example you purchase 4 items from us and you pay $26.00 for DHL Express BPR, rather than the full DHL Express cost of $31. If you do not return any items to us then you save $5 on shipping, and if you return 1 or more items to us then we will only charge you the balance due of $5 on the first item returned. For larger orders we would only charge $5 per return item to be taken off your refund - up to the DHL Express amount - and no more. By using this offer you agree to being charged as above for returns made.


Overseas Orders to outside the United Kingdom:

We are based in the United Kingdom, but we do accept orders from most countries and ship worldwide. The countries we ship to are listed in our delivery dropdown on the checkout page. While we do estimate delivery charges, we reserve the right to adjust pricing for delivery should the amount charged not cover the costs to deliver the parcel to you. Where this is applicable, we will either contact you on e-mail with the quote for delivery to take further payment, or we also reserve the right to not charge for additional shipping cost before shipping the order and to claim the amount back should any item be returned for a refund. The balance owed for shipping will be removed from the refund amount before issuing the refund.

We accept payments in GBP (£), USD ($), and EUR (€) only. For all other currencies your bank will decide the exchange rate and this is beyond our control.

All timings for delivery are also estimates and are subject to the shipping method being used and factors including but not limited to: the time it takes to clear customs, the time it takes you to settle your account with customs, and local delivery to you.

All customs and import duties and taxes will be charged to you by the delivery company on behalf of the customs department in your country. These charges are for you to pay for and are beyond our control or influence as you are the importer and owner of the goods. Any disputes regarding the amount you are charged for duties, taxes, clearing fees, and storage costs you will have to take up directly with the customs department in your country and with the shipping company you select at checkout.

Please note that you may be asked by the shipping company for your identification or social security number as it may be a legal requirement of the customs department in your country to identify who you are, as the receiver of the goods. This is a legal requirement in most countries which is between you and the customs department and the shipping company and cannot be changed by The Safari Store.

Please ensure that all goods which you order from The Safari Store to import into your country fall within the regulatory laws of your country. As the receiver of the goods, it is your duty to do so. Failure to do so could mean that your shipment is not allowed through customs in your country, resulting in delays and costs which would be for your account.

The following fees apply to overseas returned items and parcels:

1. Where you have received your parcel from us and wish to return items to us, we will refund you for the items received back from you less any import duties and taxes or shipping costs we incur should you not follow the correct procedure to return goods to us, or should we be charged any fees to clear the returns back into the UK. Please see "returns" for more information about this and returned goods rate relief. Furthermore for orders placed after the 10 June 2021 we will apply a 3.4% returns fee to all returned goods from ouside the United Kingdom to cover returns card processing fees incurred.

2. The following fees are chargeable when: a. You have refused to pay for customs duties and taxes and/or refused to accept delivery of the goods you now own; b. You have not checked that all products which you have ordered from The Safari Store fall within regulatory requirements of your country - as the importer you are responsible in terms of the law of your country to ensure that you only import goods which are not outside of your countries regulations; c. You have placed an order with us and, after a cooling off period of 24 hours (which commences as soon as we have requested additional information for your order or quoted you a higher amount on shipping, or any other matter) and you decide to abandon your order and request a refund.

3. The chargeable fees to be deducted from your refund or billed to you on invoice are:

a. 10% of the order total to cover credit card and administration costs incurred;

b. Any customs, courier, or storage related costs which are for your account and which you have not paid for;

c. Any other costs related to the return of your order to The Safari Store.

Please see 'Delivery Times and Charges' above for more information on customs clearance and charges. Note that you do save 20% on the normal retail price when you order from outside of the UK as you do not pay UK Value Added Tax when you place your order with us.


Returns Policy:

We are confident that we stock the best available products for the outdoors and safaris. If, however, you are not entirely satisfied with the products that you have chosen, you may return them to us. Please see the outline of our returns terms below, but to view our full returns policy - and for our returns system - please click here to visit our dedicated returns page.

1. From the date upon which you received your order, you have 14 days to notify us - via e-mail or by completion of our online returns form - that you will be returning items for a refund or exchange.

2. This date is worked out from the date when you received your goods. We are not able to extend this period.

3. You then have a further 14 days in which to return the items to us.

4. We will offer you an exchange or, at our discretion, a refund provided that the products are returned complete, in perfect condition, unworn or unused, unwashed, and that we are able to sell the item as a new product subsequent to the return.

5. Please do try to return items in the original packaging so that they arrive with us in the condition as described above.

6. The original delivery charge will still stand.

7. Please note: we cannot exchange or refund used or customer-damaged goods. We cannot accept items for a refund or exchange if they have been damaged in the wash.

8. For all returns, you will be required to arrange and pay for the return of the products to us as this is not built into the price of our products - unless you are using a free or pre-paid returns offer.

9. When returning items, please obtain proof of posting. We cannot accept responsibility for parcels lost in transit and we have to receive items back from you new and unused and in saleable condition to issue a refund or process and exchange.


International Returns:

Our returns policy as above also applies to our international clients and the cost for returning goods to us - and to ship the exchange items back to you - is for your account. In order to keep our pricing low and honest, we do not include the cost for international returns in our pricing.

Please also refer to the guidelines on our returns page specifically in relation to the requirement of informing your courier that the returned goods need to be declared as qualifying for Returned Goods Rate Relief.

All returns are to be sent to our UK warehouse only, even if the original order was sent from a warehouse in another country. Our UK warehouse is the only warehouse able to accept returns and we are only able to process exchanges and refunds for items returned to the UK warehouse.

Please ensure that you tell the courier you select to send the return back to us that you they must bill you for any clearance or duties charged when the goods land back in the United Kingdom. Failure to do so may result in the package being returned to you by the courier - or we may bill you for the amount charged. For refunds we reserve the right to remove any amount charged in the returns process by the courier or HMRC UK customs and excise from the refund amount due, to cover our costs.

Out of Stock Items:

Occasionally, an item will be out of stock and, if this is the case, we will contact you immediately to offer you an alternative or you may opt for a refund. Our delivery period is an estimate and may be subject to change. We cannot accept liability for any loss or damage (whether direct or indirect) for delivery at any time other than the estimated date for delivery. We will contact you by e-mail as soon as your goods have been despatched.


Gift Cards, E-gift Cards, & Gift Voucher Terms & Conditions:

Please refer to our gift cards FAQ page for specific gift card terms, conditions, and information.

The terms gift vouchers, gift cards and e-gift cards are interchangeable and terms for each apply equally to the other terms.

Gift Vouchers and gift cards are non-refundable other than within the 14 day cancellation period as per the distance selling regulations. Gift vouchers refunded within the 14 day cancellation period are subject to an 8 percent admin and card processing fee.

Discount codes - or any other promotional codes - cannot be used in conjunction with gift vouchers.

All gift vouchers are emailed to the client who placed the order only. We do not email gift vouchers to the intended receiver of the gift voucher.

Product Special Offers & Discount Code Terms:

For discount codes the following terms apply: 1. We are only able to honour verified discount codes created by The Safari Store, or created and supplied to our verified partners; 2. Unverified or unofficial discount codes through third party companies with no affiliation to The Safari Store will not be honoured; 3. Discount codes have to be applied at the time at which the order is placed and we are not able to apply discount codes retrospectively to orders once payment has been made for an order, nor are we able to process the discount retrospectively as a refund; 4. More than one discount code may not be for the same order; 4. For sign up & save offers & partner discount codes we reserve the right to change discount code percentages, and the products included in each discount code tier. To view the discount which applies to any product simply add the product to the basket and apply the discount code using the link under the Proceed to Checkout button.

For our new special offer section on the product pages for each item, where a child product is offered for a discounted or for free rate in conjunction with the parent product:

1. The child product is linked to the parent product and the offer is only valid with the parent product;

2. Should the child product be returned, we will only refund for the amount paid for that child product and not the full retail price; OR


Wholesale orders:

We do offer discounts on larger orders for one product (for example 50 or more safari hats) - please contact us to make an enquiry. Please note that all wholesale orders are charged on an ex-works basis with delivery for the clients account. We are able to quote on delivery to our wholesale clients, but we deem the relationship to be between the courier company selected by the client, and the client. Where delivery is to a destination outside of the United Kingdom import duties and taxes may be charged by the customs office for the clients country. These charges are beyond our control and are for the clients account. The client also needs to ensure that they are aware of any import regulations for their chosen country for delivery and procure the required import licenses and documentation where necessary. Please note too that we always supply a customs invoice which lists the goods at the price which the client paid for the goods - it is illegal to reduce the price for an item on the customs invoice and so we do not do this. Should an order be returned to us by the courier company due to any failure to clear the goods into the clients country then we reserve the right to either charge the client for re-delivery; and/or to retrieve any costs incurred by The Safari Store - from the client - in receiving the goods back again from the courier. This may include import duties, taxes, clearing charges and charges for our administration of the returned goods. All refunds will be subject to the goods being received in saleable condition. For returns, our standard "returns policy" terms apply as outlined in these terms and conditions.") ?>


Conformity Of Goods:

We take care to ensure that the description and specification of our products are correct at the time of going to press. However, product information and specifications given are not intended to be binding and are intended only to give a general description of the products. While the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you.

-Sizing disputes & defective goods (does not include colour - see above):

We take the accuracy of our size guides and the quality of the items we sell very seriously. As a result, very rarely are the following steps necessary, but where they are deemed to be necessary we carry them out honestly and accurately. After all, if there is a genuine issue with a product we definitely want to know about it.

Please note that the following applies only to items which are made by us, The Safari Store, and not for any third party products we stock. For third party products please see step 1 below and once we hear from you we will assist where we can, but we will also direct you to the manufacturer to resolve the issue as they are best placed to give you the best assistance.

The brands we manufacture are Mara&Meru, Rufiji, & Thusk. We operate on a 100% quality control regimen for the brands we make and every item is checked for quality and specifications - such as sizing - when we have finished each and every production run. Strict quality control is adhered to at all times. Where there is a claim that a product is defective, or where there is a claim that the size guide and information shown is not correct (for sizing this only applies to garment measurements and not body measurements which are approximates), then the following steps should be taken by you, the client:

Step 1: Contact us on email service@thesafaristore.com to report the problem. If you have images to send to us, please include them.

Please also let us know in the same email whether you wish to proceed to Step 2: where we look at the information and images provided and give you feedback after discussing with our production managers; or to Step 3: where we arrange the return with you and our shipping partners, to do the checks ourselves. Please see both Steps 2 and 3 for more information.

Step 2: Should you have opted for Step 2, then we will acknowledge your email, and then liaise with our production managers and consider the information you have provided. This is usually when our founder and chief product designer, Steve, will step in as he has a direct role in ensuring that our size guides are correct, and he has 15 years experience in clothing manufacture. We will give you honest feedback in a professional report based on the information provided. We will refer back to the information given on our size guides should this be a sizing issue. Measuring garments, as an example, is not an exact science as most people do not measure correctly and so we may provide advice on how to measure. You will still have the option to proceed to Step 3.

Step 3: If you would prefer to return the item or items to us straight away and skip Step 2, or if you feel that the issue is not resolved through our feedback provided in Step 2, then the only way for us to accurately check that your claim that goods are defective or measurements are not accurate, is to receive the item or items back from you and make the checks ourselves. We will initially cover the cost of the return, but please see Steps 4, 5, and 6 for more on this before continuing.

Please note too that at this stage the item or items may only be returned for a refund and should you wish to re-order the item or items that you will need to place a new order through our online store, thesafaristore.com. Our advice is to wait until the steps below are concluded before placing a new order.

For UK clients we will send you a Royal Mail Returns label, and for overseas clients please follow the DHL Returns Service instructions - click here - and send us the weights and dimensions for your return by email, on the same email stream as the one where your problem was reported in Step 1. We will also let you know how much the return shipping label costs, for your records, and as it relates to Step 6 below.

It is very important to note that if you decide to use another postal service or courier to return the item or items to us - or ship directly with Royal Mail or DHL rather through The Safari Store using information and labels provided by us - that we will not be able to assist with returns costs.

Step 4: Once your return is received back from you, our quality control professionals will check the item or items received. This is done with the oversight of our production managers, and once again our founder, Steve, takes an active role in overseeing this. Our assessment will be completely honest and accurate and our decision on whether or not your claim is valid will be final. We make the item or items you are disputing and so we know exactly what their specifications are and the standard of quality we specify - and things such as how to measure each item.

Step 5: Should we find that the problem you reported is accurate and we are at fault, then of course we will not charge you for the return and we will refund you for the item or items returned. We will take also steps internally to discover how an items or items slipped through our 100% quality control standard.

Step 6: Should we find that the problem reported is not valid - for example if the measurements we take show that the garment specification is correct and in accordance with our size guides - then we will retain the return shipping cost we paid to get the item or items back to us, before issuing your refund for the balance. We will take photographic or video evidence to support why we have reached this decision.

Where we find that one or some of the items returned do not have a size issue or fault, and one or some of the other items do have a size issue or fault, we will use the volumetric weight for the item or items which do not have a size issue or fault to work out the percentage of the return cost we paid for in Step 3 and retain that amount before issuing a refund. We keep weights and volumetric weights for all our products in our system.

While we will use reasonable endeavours to verify the accuracy of any information we place on The Safari Store's online store, we make no warranties, whether express or implied, in relation to its accuracy. The Safari Store's online store is provided on an as is and as available basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the The Safari Store's online store, or any transaction that may be conducted on or through The Safari Store's online store including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that The Safari Store's online store will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of The Safari Store's online store. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through The Safari Store's online store.

The limitations of liability in these conditions shall apply equally for the benefit of The Safari Store and any other associated company of The Safari Store as if references to The Safari Store included references to each such associated company.

The Safari Store will not be responsible nor liable for your use of any other websites or services such as partners of The Safari Store which you may access via links within The Safari Store's online store. The Safari Store does not control these websites or services and is not responsible for their content or service provided to you. Any such links are provided merely as a service to users of The Safari Store's online store and their inclusion does not constitute an endorsement by or affiliation with The Safari Store.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the product displayed for sale on The Safari Store's online store. This does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:

any economic losses (including, without limitation, loss of revenues, profits, contracts, business, or anticipated savings); or

any loss of goodwill or reputation; or

any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

Nothing in these terms and conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents, or employees.


UK Law:

To the extent it is possible to exclude the application of other laws and regulations, these terms and your use of The Safari Store website are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights. Our terms which govern the use of our online store and your relationship with The Safari Store have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom and we do ship worldwide as a service to you, we give no warranty, express or implied, that the use of this online store or the placing of any order through this online store from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, you are required to determine whether or not any products or promotions sold through this online store are permitted under your local law.
